Introduction and Acceptance

dwellohomes.net (the "Site") is operated by dwello Home Group, a licensed Illinois real estate brokerage, brokered by eXp Realty, located at 15736 S. Bell Road, Homer Glen, IL 60491. In these Terms of Service ("Terms"), "dwello," "we," "us," and "our" refer to dwello Home Group.

These Terms govern your access to and use of the Site. By accessing or using the Site, creating an account, or submitting a request through the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

You must be at least 18 years old and located in the United States to use the Site.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and for material changes we will provide additional notice where required. Your continued use of the Site after an update means you accept the revised Terms.

Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference and describes how we collect, use, and share your information.

License to Use the Site

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial purposes. All rights not expressly granted are reserved.

MLS Listing Data — Permitted Use and Restrictions

Property listing information on the Site is displayed in part through the Broker Reciprocity / Internet Data Exchange ("IDX") program. Listing data is sourced from the multiple listing service — Midwest Real Estate Data ("MRED") — and distributed via MLS GRID.

IDX information is provided exclusively for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. All listing data is deemed reliable but is not guaranteed accurate by dwello, MRED, or MLS GRID.

Any use or search of the data on this Site, other than by a consumer looking to purchase real estate, is prohibited. You may not scrape, harvest, crawl, spider, robotically or automatically access or collect, index, cache, copy, reproduce, redistribute, retransmit, republish, or make any commercial use of the listing data or any other content on the Site. We employ reasonable measures to detect and prevent such activity and may take action against it.

Some listings have been excluded from this Site.

The Site displays a subset of MLS data through IDX and is not itself the MLS. MRED and MLS GRID make no representations or warranties to Site users regarding the data and are intended third-party beneficiaries of these Terms.

Listing Information Disclaimers

All listings are subject to prior sale, change, or withdrawal without notice.

Listing status (for example, Active, Under Contract, Pending, or Sold) reflects the most recent data we have synced from the MLS and may lag the MLS; it may not be real-time or accurate.

Property details — including square footage, lot size, room counts, year built, property taxes, HOA or assessment amounts, and other fees — are approximate, may be inaccurate or out of date, and should be independently verified.

School, attendance-boundary, and neighborhood information is provided by third parties, is not guaranteed, and should be verified directly with the relevant school district or authority.

Photographs, virtual tours, and floor plans may be outdated and may not reflect the current condition of a property. Maps, boundaries, and location markers are approximate and are not authoritative.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current. Accounts are for a single individual who is at least 18 years old and may not be shared or transferred.

We may suspend or terminate your account or access to the Site at any time, with or without cause and with or without notice. You may delete your account at any time from My dwello → Account; our Privacy Policy explains what is erased and what we may retain.

Acceptable Use

You agree not to:

• Scrape, harvest, crawl, or use bots, spiders, or other automated means to access, search, or collect data from the Site;
• Reverse engineer, decompile, or attempt to circumvent any security or access control of the Site;
• Use the Site or its data for any commercial or competitive purpose, resell it, or use it to build or improve a competing product or service;
• Use the Site for any unlawful, infringing, harassing, deceptive, or fraudulent purpose;
• Interfere with, overburden, or disrupt the Site, or introduce malware or harmful code;
• Access another user’s account or provide false or misleading information.

We may investigate suspected violations and may suspend, block, or report accounts or activity as appropriate.

Your Submissions

You retain ownership of the content you submit through the Site (for example, notes, messages, and saved-search labels). You grant dwello a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and process that content as needed to operate the Site and provide services to you. You represent that you have the rights to the content you submit and that it is not unlawful or infringing. We may remove content and have no obligation to monitor it. If you send us feedback or suggestions, you agree we may use them without restriction or obligation to you.

Tools and Automated Features

The Site offers automated tools, including AI-assisted search that interprets your requests, and automated estimates. These tools are provided for convenience "as is," may be inaccurate or incomplete, may not reflect all matching or available properties, and are not professional advice. You are responsible for verifying results before relying on them.

Automated home-value estimates

Any automated home-value estimate on the Site is generated by an automated model using available data. It is NOT an appraisal, a broker price opinion, or a guarantee of value, may differ significantly from a property’s actual market value, and should not be relied upon in place of a professional appraisal. Consult a licensed appraiser or real estate professional for a valuation.

Mortgage and payment estimates

Mortgage and monthly-payment figures on the Site are illustrative estimates only. They are not a loan offer, a pre-qualification, a commitment to lend, or a guarantee of financing or terms. dwello Home Group is not a mortgage lender. Estimates may not reflect all costs, such as property taxes, insurance, HOA dues, private mortgage insurance, or assessments. Contact a licensed lender for an official Loan Estimate.

Nothing on the Site is legal, financial, tax, or investment advice. Consult a qualified professional for advice specific to your situation.

Real Estate Relationship; Fair Housing; Licensing

No brokerage relationship until a written agreement. Using the Site — including creating an account, saving properties, requesting a tour, submitting a contact or valuation request, or communicating with an agent — does not create an agency, brokerage, fiduciary, or representation relationship between you and dwello. A brokerage or agency relationship is established only upon execution of a written agreement in accordance with the Illinois Real Estate License Act of 2000.

Equal Housing Opportunity. dwello Home Group complies with the federal Fair Housing Act and the Illinois Human Rights Act and does not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other class protected by law.

Licensing. dwello Home Group is a licensed Illinois real estate brokerage, brokered by eXp Realty.

Agent referrals. A licensed dwello agent may refer you to another licensed real estate agent or brokerage. Any such referral is made between licensed real estate professionals, and any referral fee is paid between the licensed brokerages or agents — never between you and dwello. Third-Party Services and Links

The Site uses and links to third-party services and websites that we do not control, including mapping and location services, sign-in services, the MLS data providers, external websites, and any independent lenders, attorneys, or other providers we may mention. We do not endorse and are not responsible for third-party services or content, and your use of them is subject to their own terms and policies. Any provider we refer you to is an independent business, and you are free to choose your own.

Communications

If you provide your phone number and consent, you agree that dwello and its agents may call and text you — including by automated means — about your inquiry and our services. Consent is not a condition of any purchase. Message and data rates may apply, and message frequency varies. You may opt out of texts at any time by replying STOP (reply HELP for help) or by any other reasonable method. Marketing emails include an unsubscribe link. The specific consent shown to you at the point of collection, together with our Privacy Policy, governs these communications.

Intellectual Property and Trademarks

The Site, including its design, text, graphics, software, and the selection and arrangement of content, is owned by dwello or its licensors and is protected by intellectual-property laws. Listing data is owned by the MLS and the listing brokers and is licensed to us, not owned by us or by you. "dwello" and related names and logos are trademarks of dwello Home Group and may not be used without our permission. The REALTOR® mark and the eXp Realty marks are owned by their respective owners.

Copyright and DMCA

Disclaimer of Warranties

THE SITE AND ALL CONTENT, LISTING DATA, TOOLS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DWELLO DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE OR ITS DATA WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DWELLO AND ITS AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. DWELLO’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless dwello Home Group and its agents, affiliates (including eXp Realty), licensors, and the MLS (MRED and MLS GRID) from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms or any law, or content you submit.

Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Except where prohibited, you agree that any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Will County, Illinois, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us and attempt to resolve the dispute informally.

General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, together with the Privacy Policy and any consent shown at the point of collection, are the entire agreement between you and dwello regarding the Site. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. We are not liable for delays or failures caused by events beyond our reasonable control. Section headings are for convenience only. Provisions that by their nature should survive termination will survive. You consent to receive communications and agreements from us electronically. Nothing in these Terms creates a partnership, joint venture, or employment relationship between you and dwello.
